Terms of Service

These terms govern your use of Etudio. They reflect how the product works today; they will be finalized with legal review before public launch.

Scope

These terms apply to the use of Etudio at etudio.app by consumers within the meaning of § 13 BGB. The provider is the controller named in the Imprint. Conflicting terms proposed by the user do not become part of the contract.

What Etudio is

Etudio is a tool for planning and recording your own practice: you create pieces, exercises, and tasks, log practice sessions, and review your history. Etudio does not teach, gives no music-pedagogical advice, and owes no learning outcome.

Formation of the contract and minimum age

The contract is formed on registration: you complete the sign-up form, we send you a confirmation email, and following the link in it sets up your account.

Etudio is open to people aged 14 and over.

• If you are 16 or older, you can register yourself.
• If you are 14 or 15, the consent of your parents or another legal guardian is required (§§ 106 et seq. BGB). At registration you confirm that this consent exists.
• Under 14, registration is not possible.

Your age is a self-declaration; it is not verified. [Whether self-declaration suffices for the 14-15 bracket, or whether confirmation must be obtained from the guardian directly, is to be settled during legal review.]

Your obligations

You keep your credentials confidential and do not pass your account to third parties. You do not submit content that infringes the rights of others or breaks applicable law. For files you upload, you warrant that you hold the necessary rights.

Availability

We aim for a continuously available service but owe no particular level of availability. Maintenance, incidents at our hosting provider, and ongoing development can cause interruptions.

Pricing

[Etudio is in a public preview phase and is currently free to use. The tiers and limits shown on the pricing page are not yet enforced. This section is to be replaced when billing is introduced, together with right-of-withdrawal information, payment terms, and subscription periods.]

Term and cancellation

The contract runs indefinitely. You may delete your account at any time, without giving reasons, in your account settings; this ends the contract. We may terminate with 30 days' notice in text form; the right to terminate for cause remains unaffected.

Liability

We are liable without limitation for intent and gross negligence, and for damages arising from injury to life, body, or health. For simple negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract. ⚠️ Etudio is not a backup service. Keep your own copy of anything that matters to you.

Changes to these terms

We will notify you by email at least 30 days before a change takes effect. If you do not object before it takes effect, the change is deemed accepted; we will point this out separately in the notice. You may end the contract at any time until then. [The amendment clause is to be confirmed during legal review.]

Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. [Confirm during legal review.]
